1. Acceptance of These Terms

By downloading, installing, accessing, or using EuTalk, you agree to be bound by these Terms of Use ("Terms").

If you do not agree with these Terms, you must not use the service.

2. About EuTalk

EuTalk is a secure messaging application:

  • Developed in Europe
  • Hosted exclusively in European data centers
  • Built with end-to-end encryption based on public-key cryptography
  • Designed as a privacy-first alternative to Big Tech messaging platforms

EuTalk enables users to exchange messages, media, and calls securely.

3. Eligibility

You may use EuTalk only if:

  • You are legally capable of entering into a binding agreement under applicable law
  • You comply with these Terms and all applicable laws

EuTalk is not intended for use by children below the minimum legal age required in your jurisdiction.

4. Beta Status

EuTalk is currently provided as a Beta service.

This means:

  • Features may change, evolve, or be discontinued
  • The service may contain bugs or interruptions
  • Performance and availability are not guaranteed

By using EuTalk during Beta, you acknowledge and accept these limitations.

5. User Accounts & Security

To use EuTalk, you may be required to create an account.

You are responsible for:

  • Maintaining the confidentiality of your device and credentials
  • Safeguarding your private encryption keys stored on your device
  • All activity occurring under your account

EuTalk cannot recover lost private keys or encrypted messages.

6. Privacy & Encryption

EuTalk uses end-to-end encryption by default.

  • Only users control their private keys
  • EuTalk does not access message contents
  • EuTalk cannot decrypt private communications

By design, EuTalk cannot moderate, review, or retrieve encrypted content.

7. Acceptable Use

You agree not to use EuTalk to:

  • Violate any applicable law or regulation
  • Engage in fraud, impersonation, or deception
  • Distribute malware or harmful code
  • Harass, threaten, or abuse others
  • Attempt to compromise the security of the service
  • Circumvent encryption, authentication, or safeguards

EuTalk is a communication tool—not a platform for unlawful activity.

8. User Content

8.1 Ownership

You retain full ownership of the content you create and share using EuTalk.

EuTalk:

  • Does not claim ownership over user content
  • Does not analyze or monetize content
  • Does not use content for advertising or AI training

8.2 Responsibility

You are solely responsible for the content you share and the consequences of sharing it.

9. Service Availability

EuTalk aims to provide a reliable service but does not guarantee uninterrupted availability.

We may:

  • Perform maintenance
  • Update or modify features
  • Suspend the service temporarily

Without prior notice where reasonably necessary.

10. Account Suspension or Termination

EuTalk may suspend or terminate access if:

  • These Terms are violated
  • The service is used for unlawful purposes
  • Required by law or regulatory order

Due to encryption, EuTalk may rely on metadata or user reports, not message content, to enforce these actions.

Users may terminate their account at any time.

11. Intellectual Property

All EuTalk software, branding, logos, and documentation are the intellectual property of EuTalk or its licensors.

You may not:

  • Copy, modify, or reverse engineer the service
  • Use EuTalk branding without permission

Except where allowed by applicable law.

12. Disclaimer of Warranties

EuTalk is provided "as is" and "as available", especially during Beta.

We make no warranties regarding:

  • Continuous availability
  • Error-free operation
  • Fitness for a particular purpose

Use of the service is at your own risk.

13. Limitation of Liability

To the maximum extent permitted by law:

  • EuTalk shall not be liable for indirect, incidental, or consequential damages
  • EuTalk shall not be liable for loss of data, messages, or keys
  • EuTalk shall not be liable for misuse by third parties

Nothing in these Terms limits liability where such limitation is prohibited by law.

14. Changes to These Terms

We may update these Terms from time to time.

  • Updates will be communicated clearly
  • Continued use after changes constitutes acceptance
  • The "Last updated" date will always reflect the latest version

15. Governing Law & Jurisdiction

These Terms are governed by the laws of the European Union and the applicable national law of EuTalk's place of establishment.

Any disputes shall be subject to the jurisdiction of competent European courts.

16. Final Note

EuTalk exists to offer secure, sovereign communication without surveillance or exploitation.

Freedom to communicate comes with responsibility.
